100 Mile Radius Drivers

 

A driver must meet all of the following conditions to be considered a 100-mile radius driver - and thereby be exempt from being required to maintain a logbook.  A carrier may still require a driver to maintain a log, however, but the DOT would not.

 

The rules are different for drivers in Alaska, Hawaii, for a driver-salesperson and  retail store deliveries, for farmers/agricultural, ground water well drilling operations, construction and utility service vehicles.  For more info, see the FMCSR's, Part 395.1.

 

To qualify for 100 mile exemption:

  • The driver must drive within a 100 air-mile radius of the normal work reporting location.

  • The driver must return to normal work reporting location and be released from work within 12 consecutive hours.

  • The driver must have at least 8 consecutive hours off duty separating each 12 hours on duty.

  • The driver must not drive more than 10 hours following 8 hours off duty.

  • The employer must keep time records for 6 months showing the time you report for duty and are released from duty each day, the total number of hours the driver is on duty each day and the total time the driver is on duty for the past 7 days if the driver is used for the first time or intermittently.
